👉SUBJECT: ALARMING RISE IN MOB LYNCHING AND COMMUNAL VIOLENCE AND DIRE NEED FOR ENACTMENT OF LAW AS DIRECTED BY HON’BLE SUPREME COURT OF INDIA

Respected Sirs/Madams,

At the outset, I take this opportunity of congratulating you on your phenomenal success in the recently held Lok Sabha Elections.  I am optimistic that you, being an elected Member of Parliament, will work for the welfare and betterment of the Country under the constitutional framework.

I would like to draw your kind attention to the fact that there is an alarming rise in hate crimes, particularly against the marginalized and downtrodden sections of society wherein Muslims are being particularly targeted by some fringe elements and are being lynched to death and these barbaric incidents are becoming common public spectacles around the country. Such barbaric acts, without elaborating further, are a grave menace to the concept of the egalitarian democratic setup as envisaged by founding fathers of our exalted constitution.

You, as an elected Member of the Parliament, have taken an oath on the Constitution to preserve the constitutional framework of this great country.  This is to bring into your kind and imperative attention that as a citizen of India I feel that it is a duty incumbent upon you to act and work for the betterment of this great nation as well as its people.

Our constitutional framework is celebrated all across the world for its vibrant covenants.  Our Constitution is being daily lynched when a person is lynched for the food he had; our Constitution is trashed when the basic rights of the individual are infringed; when we deny the power of love to people on grounds of religion and castes, the Constitution weeps.  When a Muslim youth is killed by fringe mob and when a Dalit youth is burnt for riding on a horse for his wedding, it is the Constitution which is maligned.  For your kind information please note that the Constitution works, even if it does not matter to us.  Constitution affects us even if we don’t believe in it.  Our Constitution has a transformative vision, which seeks to heed to people the power of destiny.  Individual is its basic unit.  A constitution culture is based on the belief that it unifies people beyond our immediate sphere of acquaintance.  Our Constitution is a text that governs over 1.2 billion people speaking 22 constitutionally recognized languages and hundreds of dialects, and practicing virtually every religion of the world.  Indian constitutionalism is described as a boisterous and contentious enterprise that strives to endow the largest, most diverse and complex democracy with legal form.

I am deeply pained and anguished about the hate crimes being committed against the downtrodden and marginalized section of society especially Muslims and Dalits.  While reading the newspaper or watching the television when the news of lynching of a person come across to me, I feel disgusted and disturbed.  My conscious is shaken and my heart weeps when such news, which is fast becoming the new normal, on a regular basis, is printed / telecasted.

The Hon'ble Supreme Court of India in a case bearing W.P. (Civil) No. 754/2016 on which the judgment was delivered on 17.07.2018, while dealing with this issue of mob-lynching, has directed the Union Government to take preventive, punitive and remedial measures to tackle the rising problem of mob-lynching.  The Hon'ble Supreme Court has issued directions under the same three heads as mentioned foregoing.  In its judgments as aforementioned, the Hon'ble Court has aptly observed that “a fabricated identity with bigoted approach sans acceptance of plurality and diversity results in provocative sentiments and display of reactionary retributive attitude transforming itself into dehumanization of human beings.  Such an atmosphere is one in which rational debate, logical discussion and sound administration of law eludes thereby manifesting danger to various freedoms including freedom of speech and expression.”  The Hon'ble Court has further observed “intolerance arising out of dogmatic mind-sets sows the seeds of upheaval and has a chilling effect on though and expression.  Hence, tolerance has to be fostered and plasticised and not allowed to be diluted in any manner.”

The Hon'ble Supreme Court while condemning the incidents of lynching and mob-violence against the Dalits and Minority community members has described as horrendous acts of mobocracy and has asked the Parliament to pass a law establishing lynching as a separate offence with punishment.  The Hon'ble Court has held that it is indeed an obligation of the State to protect its citizens and to ensure that the pluralistic social fabric of the country holds good against the mob-violence.  The Hon'ble Court has asked the Parliament that such law should be effective enough to instil a sense of fear in the perpetrators.  Having said that, it is an obligation of the Centre and States to ensure that nobody takes the law into his hands nor become a law unto himself.  As an elected Member of Parliament, I believe that it is your duty to fight for the right within our Constitution framework.  In a vibrant democracy like India, the menace of lynching which is a classic example of sheer mob-violence and savagery has to be dealt with to protect our constitution values as enshrined in the Constitution.

For your kind information and ready reference I am reproducing hereunder the 11 points prescription which the Hon'ble Apex Court has directed for:

👉The state governments shall designate a senior police officer in each district for taking measures to prevent incidents of mob violence and lynching.

👉The state governments shall immediately identify districts, sub-divisions and villages where instances of lynching and mob violence have been reported in the recent past.

👉The nodal officers shall bring to the notice of the DGP any inter-district co-ordination issues for devising a strategy to tackle lynching and mob violence related issues.

👉It shall be the duty of every police officer to cause a mob to disperse, which, in his opinion, has a tendency to cause violence in the disguise of vigilantism or otherwise

👉Central and the state governments should broadcast on radio and television and other media platforms including the official websites that lynching and mob violence shall invite serious consequence .

👉Curb and stop dissemination of irresponsible and explosive messages, videos and other material on various social media platforms. Register FIR under relevant provisions of law against persons who disseminate such messages.

👉 Ensure that there is no further harassment of the family members of the victims.

👉State governments shall prepare a lynching/mob violence victim compensation scheme.

👉Cases of lynching and mob violence shall be specifically tried by designated court/fast track courts earmarked for that purpose in each district. The trial shall preferably be concluded within six months.

👉​To set a stern example in cases of mob violence and lynching, the trial court must ordinarily award maximum sentence upon conviction of the accused person.

👉​If it is found that a police officer or an officer of the district administration has failed to fulfill his duty, it will be considered as an act of deliberate negligence.

From the aforesaid, it is crystal clear that the Hon'ble Supreme Court has also proposed day-to-day trial in fast track courts and additionally maximum punishment to the accused in mob-lynching cases.  The Judgement is very strongly worded and the Court has acknowledged that this is a matter of grave concern.  The cases of mob-lynching are increasing day-by-day and it has now begun to evolve into an epidemic whereby members of minority communities are specifically and savagely being targeted with a view to instil terror and to keep such minority and downtrodden communities suppressed. Unfortunately, it appears that the perpetrators of such crimes are acting in concert and thus, this menace has taken a shape of organized crime. Furthermore, since there is a clear and undeniable purpose to these horrifying acts, which is to terrorize the minority and downtrodden communities, this organized crime has assumed the role and characteristics of a brutal and bloodthirsty terrorist movement. Such an organised terror needs to be dealt with immediately and effectively or else, this grave menace shall completely damage the rule of law, the supremacy of the constitutional values and morality.

As a Member of Parliament, specially coming from Muslim community, I hope that you are sensitized on this matter. I urge you to exhaust all remedies available at your disposal being a Member of Parliament to ensure that the Government implements the directions of Hon'ble Supreme Court of India without any delay or demur.  Be it raising questions in Parliament, or moving private member bill, please do the needful.  If the Government is not paying any heed to your legitimate demands, I would like to remind you about the father of our nation Mahatma Gandhi in this context.  He used his weapon of ‘Satyagraha’ to fight the mighty English Power.  I urge you to do a Satyagraha and proceed to “fast unto death / indefinite hunger strike” inside or outside the Parliament premises, in accordance with law, to ensure that the Government accepts your legitimate demands.  It is an immediate and urgent need of the hour and know that if you don’t act now, history will never forgive you for your complicity and apathy.

I don’t expect any response from you to this letter rather I expect that you will act to discharge your duty under the Constitutional framework to ensure justice to the grieving families who have lost their loved ones in mob-lynching.  I expect you to act in accordance with the hopes and expectations of the people of India who have elected you to the highest citadel in the country, I expect you to work in order to ensure justice, I expect you to uphold the rule of law as per the oath that you have taken upon entering the Parliament.
